After the Firm secured victory for one of the Chapar Firm’s clients in a jury trial in the Federal District Court for the Northern District of Georgia, the Firm was called upon to defend that victory upon the other party’s appeal to the 11th Circuit Court of Appeals.  Following extensive briefing, Attorney Chapar appeared in January 2011 to argue the matter orally before a three-judge panel of the 11th Circuit.  The 11th Circuit panel issued a prompt written ruling and affirmed the prior trial judgment in favor of the Chapar Firm’s client.

The case turned upon the interpretation of the Uniform Commercial Code.  A buyer had sued the Firm’s client, alleging certain deficiencies in paperwork associated with transportation trailers sold by the client.  However, the plaintiff had never invoked its remedy of rejection, but rather undertook to sell those very trailers.  As a result, the plaintiff accepted the trailers with knowledge of the condition of the paperwork and could not recover from the Firm’s client.  The 11th Circuit Opinion is WOODRIDGE USA PROPERTIES, L.P. v. SOUTHEAST TRAILER MART, INC. and the opinion may be read here.
