The firm represents a client in a breach of contract action. The Trial Court granted summary judgment to the plaintiff, finding that there was no jury question regarding the alleged contract breach.
However, the Firm appealed, and urged the Georgia Court of Appeals to find that the client had a right to a trial on the question of whether any contract was breached.
The Georgia Court of Appeals reversed the grant of summary judgment, finding that a jury question did in fact exist as to whether there was a breach of any contract, and remanded the case for trial.
The case is reported at HAMPTON ISLAND CLUB v. B2 CREATIVE, INC., A09A2037 (Ga.App. 9-28-2009).
